Questions and Answers

What is important to know before entering into a real estate transaction?

David Soffer Law Firm FAQ ICon
  • What happens during the initial consultation or first call?
The first step is to review the circumstances, the documents already available, and the decision or transaction ahead. From there, we can identify what needs to be examined, where the main risks may lie, what options are available, and how best to proceed. The goal is to bring clarity to the situation before taking a significant legal or business step
  • When should I involve a lawyer in a real estate transaction?
Ideally, before signing any binding document and before transferring a deposit or making any commitment to a seller, developer, or other party.

A real estate transaction should be reviewed in advance from several angles, including title and ownership rights, registration, tax implications, contractual obligations, and key deadlines. These issues are best addressed before entering into commitments that may be difficult or costly to reverse.
  • I have a property, an inheritance matter, or a transaction. How do I know whether I need legal advice?
Whenever a matter involves property, legal rights, money, registration, or several parties with competing interests, an early legal review is usually advisable.

Even matters that appear straightforward — such as transferring property within a family, selling or purchasing a property, dealing with an inheritance, or entering into an agreement — may carry tax consequences, registration requirements, contractual obligations, or the potential for future disputes
  • I received a draft agreement. Is it enough to review it myself?
It is generally not advisable to rely solely on a personal reading of a contract, particularly in real estate transactions, substantial lease agreements, purchases from developers, commercial agreements, or financial commitments.

A legal review considers not only what the agreement says, but also what may be missing: deadlines, security arrangements, liability provisions, supporting documents, termination rights, and risks that may not be apparent on a first reading.
  • My matter involves several areas at once: real estate, tax, inheritance, or a company. Where do we start?
We start by looking at the full picture. Many legal matters involve several overlapping layers, such as real estate, taxation, title registration, heirs, companies, shareholders, or disputes between parties.

Rather than treating each issue in isolation, it is important to understand how the different elements interact and which decisions may affect the next stage of the matter.
  • Is it worth consulting a lawyer even before a dispute arises?
Yes. In many cases, there are more options available before a dispute develops. Clear drafting, early legal review, proper documentation, negotiation, and the timely regulation of rights can often prevent uncertainty from turning into a conflict.

Once a dispute has already escalated, the available options may become more limited and the legal process more complex.
  • Buying a property from a developer: what should be reviewed before proceeding?
When purchasing from a developer, it is important to look beyond the purchase price and technical specifications. The agreement, buyer protections and security arrangements, delivery dates, indexation provisions, the developer’s rights, registration status, future registration of title, and additional costs should all be examined carefully.

These issues can directly affect the overall cost of the transaction, the expected timeline, and the ability to complete the purchase smoothly and securely.
  • Does it make a difference if the property or transaction has an international element?
Yes. If the client is based abroad, if a non-resident is involved, if documents are being executed outside Israel, or if an Israeli property is being managed remotely, additional practical and legal considerations may arise.

These may include execution and authentication of documents, ownership and registration issues, taxation, powers of attorney, and representation before the relevant authorities. In such cases, effective legal guidance needs to address both the transaction itself and the practical realities of managing the process from abroad.
